EXPOSED: The XYZ Affair . . .
Q2807 WE CANNOT AFFORD TO LOSE THIS RARE OPPORTUNITY TO RIGHT THE WRONGS.
WE, THE PEOPLE, MUST RECLAIM WHAT IS RIGHTFULLY OURS. WE MUST RISE. WE MUST FIGHT.
Logan Act, legislation enacted by the United States Congress (1799) that forbids private citizens from engaging in unauthorized correspondence with foreign governments. As amended, the act reads:
Any citizen of the United States, wherever he may be, who, without authority of the United States, directly or indirectly commences or carries on any correspondence or intercourse with any foreign government or any officer or agent thereof, in relation to any disputes or controversies with the United States, or to defeat the measures of the United States, shall be fined under this title or imprisoned not more than three years, or both.
This section shall not abridge the right of a citizen to apply, himself or his agent, to any foreign government or the agents thereof for redress of any injury which he may have sustained from such government or any of its agents or subjects.
During the 1790s tensions were high between the United States and France. In 1778 France had formally allied itself with the 13 American colonies and French military and financial support was critical to the success of the American Revolution. As the French Revolution intensified and the ancien régime was swept aside in 1789, France’s Revolutionary government looked to the United States for support. As the powers of Europe moved to stifle France’s attempts to export its revolution, factions within the cabinet of U.S. Pres. George Washington advocated a range of responses to the French Revolutionary wars. Washington wished to adhere to a policy of strict neutrality between the belligerents, while treasury secretary Alexander Hamilton sought closer ties with Britain. Secretary of state Thomas Jefferson, who had just returned from a five-year mission in Paris, promoted a pro-French policy under the terms of the 1778 treaty. In the end, Hamilton’s Federalists carried the debate, and the French were incensed when the United States passed the Jay Treaty in 1794. The treaty smoothed relations and expanded commercial ties with Britain. France, interpreting this as a violation of the 1778 treaty, placed an embargo on U.S. merchant ships and detained the seamen.
In 1797 U.S. Pres. John Adams sent three U.S. ministers to France to negotiate a commercial agreement to protect U.S. shipping. These representatives were approached by three French agents (identified as X, Y, and Z in diplomatic correspondence), who solicited a bribe before negotiations even started. The resultant XYZ Affair caused an outcry in the United States.
In order to stave off war, statesman George Logan traveled to France in 1798 as a private citizen to meet with government officials. Although he successfully concluded a pact whereby France ceased all detrimental actions against U.S. merchant ships, he was criticized upon his return to the United States. Political opponents called his acts treasonous. On January 30, 1799, the Logan Act was thus passed by the U.S. Congress to prevent any individual from corresponding with a foreign government without permission from the U.S. government. [1] Q1948 KERRY should be VERY nervous.
President Trump called out former Obama Secretary of State John Kerry for a likely violation of the Logan Act for his working with Iran against the United States.
Trump tweeted his criticism of Kerry as he commented on new harsh sanctions against Iran targeting the state sponsor of terrorism’s for oil exports by the elimination of waivers for importers.
POTUS wrote Saudi Arabia and others in OPEC will more than make up the Oil Flow difference in our now Full Sanctions on Iranian Oil. Iran is being given VERY BAD advice by @JohnKerry and people who helped him lead the U.S. into the very bad Iran Nuclear Deal. Big violation of Logan Act?
The White House says the U.S. is ending exemptions from sanctions for countries that import Iranian oil. In a statement, the White House said it was taking “timely action to assure that global demand is met as all Iranian oil is removed from the market.”
Secretary of State Mike Pompeo was to discuss the move at the State Department Monday morning. The decision means sanctions waivers for five nations, including China and India and U.S. treaty allies Japan, South Korea and Turkey, won’t be renewed when they expire on May 2.
The Logan Act, which bars American citizens from negotiating with foreign governments without authorization, has not been used to prosecute anyone. However, it was used by the Obama administration to target Gen. Mike Flynn during the transition when he was recorded speaking with the Russian ambassador to the U.S. to hold off retaliating against Obama administration expulsions of Russian diplomats over Russia meddling on the 2016 presidential election. Flynn was not prosecuted for a Logan Act violation.
Former Secretary of State John Kerry has been engaging in shadow diplomacy to try to preserve the Iran nuclear deal, a major diplomatic achievement of his, according to a new report.
Over recent months, Kerry has been holding meetings and speaking with big players in the Iran nuclear agreement, who, like Kerry, do not want President Donald Trump to withdraw the US from the deal.
It has been reported that Kerry had met with Iran Foreign Minister Javad Zarif at the United Nations in New York two weeks ago, their second meeting in about two months, to discuss ways of keeping the deal limiting Iran’s nuclear weapons program intact.
This tweet from President Trump sums this up in a perfect way:
The United States does not need John Kerry’s possibly illegal Shadow Diplomacy on the very badly negotiated Iran Deal. He was the one that created this MESS in the first place! [2]
